MR. HENDERSON: At this time, the defense calls Deputy John Alden.
JOHN ALDEN
being called as a witness, and having first been duly sworn,
testified as follows:
JOHN ALDEN: I do.
COURT CLERK: Thank you.
THE COURT: Sir, good morning. Can you state and spell your name for the record?
JOHN ALDEN: John Alden, J-o-h-n A-1-d-e-n.
THE COURT: All right. Thank you, sir. You may be seated.
Mr. Henderson, you may inquire.
DIRECT EXAMINATION
BY MR. HENDERSON:
MR. HENDERSON: Good morning, sir.
JOHN ALDEN: Good morning.
MR. HENDERSON: Sir, how are you employed? How are you employed?
JOHN ALDEN: I'm employed with the Orange County Sheriff's Office as a corporal.
MR. HENDERSON: Okay. Back on August the 28th of 2019, how were you employed?
JOHN ALDEN: I was a deputy in uniform patrol division in Sector 2.
MR. HENDERSON: Okay. As a part of your job duties that day, did you have the occasion to respond to 4748 Frantz Lane, No. 3?
JOHN ALDEN: Yes.
MR. HENDERSON: What was the purpose?
JOHN ALDEN: There ended up being a battery call.
MR. HENDERSON: Okay. And, sir, were you the lead officer on this case?
JOHN ALDEN: Yes.
MR. HENDERSON: Were there any other backup officers there with you?
JOHN ALDEN: I believe so.
MR. HENDERSON: Okay. Sir, on that date, August the 28th of 2019, did you come in contact with Sarah Boone?
JOHN ALDEN: Yes.
MR. HENDERSON: Okay. Sir, on that date, did you observe any injuries on Sarah Boone?
JOHN ALDEN: I observed redness on the left side of her neck and looked to be an old injury to her right eye.
MR. HENDERSON: Sir, on August 28th of 2019, did you come in contact with Jorge Torres?
JOHN ALDEN: Yes.
MR. HENDERSON: And did you notice any injuries on Mr. Torres?
JOHN ALDEN: Yes. He had some redness by his left eye.
MR. HENDERSON: Sir, on that day, was Mr. Torres placed under arrest?
JOHN ALDEN: Yes.
MR. HENDERSON: Thank you. I have no further questions.
THE COURT: Any cross-examination?
CROSS-EXAMINATION
BY MR. JAY:
JOHN ALDEN: From my report, I remember marking the left -- light redness by his left eye.
JOHN ALDEN: I believe so.
MR. JAY: All right. And so that would be the best evidence of both video and audio as to what occurred while you were on scene?
JOHN ALDEN: It would, especially since this happened four years -- well, five years ago now.
JOHN ALDEN: He did.
MR. JAY: Based on the conclusion of your investigation, which involved talking to Ms. Boone and attempting to talk to Mr. Torres, as well as your visual observations of both of them in the scene, is that how you-all reach your conclusions?
JOHN ALDEN: Yes.
THE COURT: Any redirect?
MR. HENDERSON: No, Your Honor.
THE COURT: Can this witness be released?
MR. HENDERSON: Yes, Your Honor.
THE COURT: Mr. Jay?
THE COURT: Thank you, sir.
JOHN ALDEN: Thank you.

THE COURT: Defense, you can call your next witness.
MR. HENDERSON: Judge, may we approach?
THE COURT: Yes.
(At the bench.)
THE COURT: Yes, sir?
MR. HENDERSON: Judge, Dr. Brannon was supposed to be our next witness. Mr. Beck informs me that he's not here yet.
Have you had contact with him?
MR. BECK: I have. I've contacted him via text this morning. He indicated that he is going to be arriving at the courthouse around 9:30.
THE COURT: Okay. Do you have another witness that we might be able to fill the bridge?
MR. HENDERSON: I'm trying.
THE COURT: Detective Lowen is here?
MR. OWENS: The detectives are here.
THE COURT: Can we do that?
MR. HENDERSON: I'11 do that.
